COMMUNITY GUIDELINES AND ACCEPTABLE USE POLICY

1. PURPOSE AND APPLICABILITY These Community Guidelines and Acceptable Use Policy (“Guidelines”) set out the standards of conduct, permissible use, and restrictions applicable to all users, visitors, customers, clients, and any other persons (“Users”) who access, interact with, or make use of the Company’s website, platforms, applications, communication interfaces, or any associated digital services (collectively, the “Platform”). These Guidelines are intended to ensure lawful, secure, respectful, and responsible use of the Platform and shall be read in conjunction with the Terms of Service and Privacy Policy of AKSHIRYAKRITI IT SOLUTIONS PRIVATE LIMITED (the “Company”). By accessing or using the Platform, you agree to comply with these Guidelines at all times. 2. GENERAL STANDARD OF CONDUCT Users are expected to use the Platform in a manner that is lawful, responsible, and consistent with applicable legal and regulatory requirements. All interactions with the Platform, including communications, submissions, and use of services, must be undertaken in good faith and without causing harm to the Company, its systems, its personnel, other users, or third parties. The Platform is intended for legitimate business, informational, and professional purposes. Any use that deviates from such purpose or that undermines the integrity, security, or lawful operation of the Platform shall be considered a violation of these Guidelines. 3. PROHIBITED CONDUCT Users shall not engage in any activity that is unlawful, harmful, abusive, or otherwise objectionable. Without limiting the generality of the foregoing, Users shall not use the Platform to host, upload, transmit, store, publish, or otherwise make available any content or material that is illegal, fraudulent, defamatory, obscene, sexually explicit, abusive, threatening, hateful, discriminatory, invasive of privacy, or otherwise violative of Applicable Law. Users shall not impersonate any person or entity, misrepresent their identity or affiliation, or provide false, misleading, or inaccurate information.
Users shall not engage in any activity that interferes with or disrupts the Platform, including attempting to gain unauthorized access to systems, introducing malicious code, conducting denial-of-service attacks, exploiting vulnerabilities, or bypassing security measures. Users shall not use automated systems, bots, crawlers, or scraping tools to access, extract, or collect data from the Platform without the Company’s prior written consent. Users shall not use the Platform to develop, train, benchmark, or enhance any competing product, service, or technology, or to derive commercial advantage through unauthorized use of the Company’s systems, content, or intellectual property.
4. USER SUBMISSIONS AND COMMUNICATIONS
To the extent that the Platform permits Users to submit information, communicate with the Company, or upload any materials, Users shall ensure that all such submissions are lawful, accurate, and do not infringe any third-party rights. Users shall not submit confidential, proprietary, or sensitive information unless such submission is required as part of a formal engagement governed by a separate written agreement with the Company. The Company reserves the right, but not the obligation, to review, monitor, or remove any user submissions where it reasonably believes that such content violates these Guidelines, Applicable Law, or the Company’s policies.
5. DATA PROTECTION AND PRIVACY AWARENESS Users shall not use the Platform to collect, process, store, or transmit personal data of other individuals in violation of applicable data protection laws, including the Digital Personal Data Protection Act, 2023. Users are responsible for ensuring that any personal data shared through the Platform is shared lawfully and with appropriate authorization. The Company shall not be responsible for any unauthorized or unlawful disclosure of personal data by Users.
6. THIRD-PARTY RIGHTS AND INTELLECTUAL PROPERTY
Users shall not use the Platform in a manner that infringes or misappropriates the intellectual property rights, privacy rights, publicity rights, contractual rights, or any other rights of third parties. Any unauthorized use, reproduction, or distribution of the Company’s content, software, or materials is strictly prohibited.
7. REGULATORY COMPLIANCE
Users shall comply with all Applicable Laws in connection with their use of the Platform, including but not limited to the Information Technology Act, 2000, the Consumer Protection Act, 2019, data protection laws, intellectual property laws, and laws relating to cybercrime and electronic communications. Users shall not use the Platform in any manner that may expose the Company to legal liability, regulatory action, or reputational harm.
8. ENFORCEMENT AND ACTION The Company reserves the right, at its sole discretion, to investigate any suspected violation of these Guidelines and to take appropriate action, including restricting access, removing content, suspending or terminating access to the Platform, or reporting the matter to relevant authorities. Such action may be taken without prior notice where the Company reasonably believes that immediate action is necessary to protect its systems, users, or legal interests. 9. DISCLAIMER The Company does not undertake any obligation to actively monitor user activity or content. Users acknowledge that the Company’s role is limited to providing access to the Platform and that responsibility for compliance with these Guidelines rests primarily with the Users. 11. MODIFICATIONS The Company reserves the right to modify or update these Guidelines at any time. Updated versions shall become effective upon publication on the Platform.
